Will of James Poplewell 1605

The third day of July in the year of our lord God 1605, and in the third year of the reign of our most gracious and dread sovereign Lord James the kinges majesty that now is, I James Poplewell of Belton in the Isle of Axholm & County of Lincoln yeoman sick in body but of good and perfect remembrance (thanks be given unto almighty god) do ordain Constitute and make this my Last Will and Testament in manner and form following
First and principally I Commend my soul into the hands of Almighty God the father, son and holy ghost, three distinct persons and one only god in majesty power and glory, none of them above nor before another all three Coequall and Coeternall, and I hope assuredly to be saved by the only merits death and passion of Jesus Christ my only saviour and redeemer
And my will is that my body shall be buried in the parish Church of Belton aforesaid
Item; I give and bequeath unto John Poplewell my eldest son, all that my messuage or tenement with all the houses and edifices there upon being (wherein I now dwell) together with all the Closes of Land meadow and pasture which I bought and purchased of Robert Browghton and Albane Poplewell containing altogether fourteen acres (more or les) And also two acres of meadow lying in Clymmarcarr within the parish of Owston which I bought and purchased of Sir Peter Eure Knight, by the name of Peter Eure esquire and eight Acres xx --- of land arable sunderly Lying in the fields of Belton aforesaid that is to say, three Acres & a half sometimes belonging to Shurlock farme, One half Acre bought of Sir John Ferne Knight, by the name of John Ferne esquire in the way of exchange/ One Acre and three roodes bought of Richard Bernard, One Acre of Land bought of Thomas Hallifax one three rood of Land Lying in Lincroft [/Linwoft] bought of Robert Poplewell of Hambletwaite which was late Alexander Newlandes one half Acre of land lying at marsh meare late Anthonie Pies And five Acres of Land arable that was my fatheres with one millhill And a Close of meadow lying at Belwood brigge To have and to hold the said messuage or tenement with all & singular the premisses aforesaid with their & every of their Appurtenances unto the said John Poplewell (so soon as he shall Come to the age of one and twenty yeares) and to the heires of his body Lawfully begotten for ever
And for want of such issue of his body Lawfully begotten, then all the said messuage and other the premisses aforesaid wholy to remain to Thomas Poplewell my second sonne (when and soon as he shall Come and attain to the Age of one & Twenty yeares and to the heires of his body lawfully begotten, and for want of such issue of his body lawfully begotten, then my will is that the said messuage and all other the premisses aforesaid shall wholy remain & Come to Robert Poplewell my third sonne (when and so soon as he shall Come and attain to the Age of Twenty and one yeares) and to the heires of his body lawfully begotten and for want of such issue of his body lawfully begotten Then my will is that the said messuage and tenement and all and singular the premisses aforesaid with their Appurtenances shall remain wholy to William Poplewell my fourth sonne (when and so sonne as he shall attain and Come to the age of one and Twenty yeares) to him and to the heires of his body Lawfully begotten, And for want of such issue of his body Lawfully begotten, Then my will is that the said Messuage and tenement and all and singular the premisses aforesaid shall remain to the right heires of me the said James Poplewell for ever Provided always and my Will is that if either my sonne John Poplewell or annie other of my sonnes aforesaid, shall go about to Alien or sell away the said Messuage or tenement or the said Closes of land arable meadow and pasture Containing fourteen [14] Acres (more or les) to whom the said premises shall descend & Come, that he or they which shall so go about to alter this my said gift shall **** the benefit thereof and the same shall remain to the next heir in such manner & form as is before bequeathed and given
Item; I give and bequeath unto Thomas Poplewell my second sonne aforesaid all that my messuage & Tenement & Croft thereto adjoining which I bought and purchased of William Broughton deceased, and Thomas Davy, together with Eleven Acres and one rood of arable land (more or les) jointly & severally lying in Belton field aforesaid which was late Mounsons To have and to hold to him his heirs and assignes for ever And if my sonne Thomas Poplewell shall happen to Dye depart this Life without any issue then my will is that the said Messuage and tenement & other the premisses aforesaid shall remain to Robert Poplewell my third sonne aforesaid to him his heires and assignes for ever
Item; I give unto the said Robert Poplewell my third sonne, All that my messuage or Tenement scituate in Carr house with all the buildinges thereon standing and being together with ten selions of land arable containing by estimation four Acres (more or les) Late Richard Poplewells, and also one Acre of land which I bought and purchased of the said William Broughton Lying at Marsh meare To have and to hold the said Messuage & Tenement with all & singular the premisses aforesaid with their Appurtenances to the said Robert Poplewell his heirs & assignes for ever And if the said Robert Poplewell shall happen to dy and depart this life without issue, then my will is that the said Messuage and tenement & other the premisses aforesaid shall remain to William Poplewell my fourth sonne aforesaid to him his heires & assigns for ever
Item; all the rest of my Landes not before given I give and bequeath them to the said William Poplewell his heires and assigns for ever And if the said William shall happen to Die & Depart this life without issue, then my will is that his land shall remain to the said Robert Poplewell his heires and assigns for ever
Item; I give unto Robert Poplewell my sonne aforesaid the sum of ten poundes of Lawful money of England to be paid to him by my executrix within one month next after he shall come to the Age of one & twenty years]
Item; I give unto the said William Poplewell my sonne Thirty poundes in money or money worth to be paid to him within one month next after he Come to one and twenty yeares provided always that if it shall please god the said Robert to die and Depart this life before he come to the Age of one & twenty yeares that then the said ten poundes shall be equally Divided and paid to the said Thomas & William or the survivor of them Like wise my will is that if happen the said William to dy and Depart this transitory life before he come to the full age of one & Twenty yeares then the said £30 shall be equally paid & divided between the said Thomas and Robert or to the survivor of them
Item; I give unto Elizabeth Poplewell, Dorothy Poplewell and An Poplewell my Daughteres to every of them forty poundes a piece in money or money worth to be paid to them when and so soon as they accomplish and Come to their several ages of one & twenty yeares or marriage whether happens first Provided always & my will is that if any of my Daughteres aforesaid shall Die & Depart this life before their Age of one & twenty yeares or marriage that then the survivores or survivor of them shall have that part or parts of them so dying equally between them
Provided always and my will is that if John Poplewell my eldest sonne shall Die and depart this life without such issue as before is expressed, that then Thomas Poplewell my second sonne shall have the messuage & tenement wherein I now Dwell together with all the premisses aforesaid to the said John given and bequeathed upon Condition that the said Thomas shall avoid the possession of that messuage or tenement and Croft & xj Acres & one rood of land aforesaid And the same my will is shall remain then to the said Robert Poplewell his heirs and assignes for ever, And then the said messuage & tenement in Carhouse aforesaid together with the arable land aforesaid to the said Robert before given shall wholly remain to the said William Poplewell his heires and assignes for ever
Item; I give unto every one of my said sonnes and Daughteres one silver spoon to be delivered them at their several Ages of one and Twenty years
Item; I give unto that man which shall preach at my burial iij s iiij d
Item; I give unto the poor people of Belton Thirteen shillinges iiij d to be distributed to them at my burial
Item; where as George Tailor did give by his last will and Testament xviijd towardes the buying of a book to the use of the Church, which said xviij d is now in my hand my will is that my Executrix shall make it iij s towardes the buying of one
Item; I give to every one of my sisters one xiijd ob a piece
Item; I give unto Elizabeth my wife all my landes and tenements whatsoever To have and to hold to her & her assignes During the several nonage of all my said sonnes, I mean every ones parte and purpartie to them given as before is expressed
The rest of my goodes & Chattels not willed given nor bequeathed my debtes being paid and my funeral expenses discharged I give them unto the said Elizabeth my wife whom I make sole Executrix of this my said testament and last will Provided always that she shall before any contraction to be made with any man, Ly in good and sufficient bond by her self & other sufficient sureties for the true performance of this my said Testament and last will, and for the well educating and bringing up of every one of my said Children During their several minorities, to my said supervisors here under named, And if she shall refuse soe to do then my will is that my said supervisors shall enter upon my said Children portions and they to enter **** into sufficient bond unto four of my next Kinsfolkes and nearest of blood for the next payment of their portions and the said portions to keep according to the tenor hereof
And I appoint Christoper Rayner, John Trent, Robert Broughton and John Singleton supervisors of this my said testament and Last will and my will is that they shall every one have a xiijd ob and their Churges borne at all times in and about my business
