  • Only one John Kinsman has been found who was baptised at any time around 1815 in Calstock, yet he seems to have had two very distinct futures, unless there is another, as yet undiscovered John Kinsman of this age and place.

    John first fell foul of the law in 1837, in the company of James Morgan (his brother-in-law?):

    Devon Quarter Sessions - Epiphany 1837

    James Morgan [25] and John Kinsman [21]
    Committed by J. Phillips Carpenter, clerk, charged with having on the 30th September last, at Sydenham Damerel, violently and maliciously assaulted, and beaten William Gadgecombe. Warrant dated 4th October, 1836.

    He was then tried for theft in 1838. A full transcript of this trial is in the documents section. He was charged with having stolen 37 sovereigns, seven half-crowns, and three shillings from one William Trevan. He was found guilty and sentenced to seven years transportation.

    Obviously, circumstances at home were not very good, as, after sentence was passed, his parting words in the court were reported as "I'd rather be transported for life than go home to my wife".

    No evidence has been found that John was actually transported, more likely he spent his 7 years in gaol somewhere in England.

    Susannah married again (bigamously) to Peter Williams in 1843 and remained with him for at least another 20 years.

    John has not been found on the 1841 census, but turns up in 1851 with a new wife, Sarah, and children. No certain marriage record for John and Sarah has yet been found.
