Will of Francis Kinman, Founder of Shoe Lane. 1823



This is the last will and Testament of me Francis Kinman of Shoe Lane, Fleet Street in the City of London, founder


I give and bequeath unto my late foreman Robert Haskins now employed at the Hodson foundry, Bankside in the County of Surrey, founder, all my gun patterns 


And I give and bequeath all other my personal estate and effects of what nature or kind so ever and wheresoever unto William Hill, of Brixton Hill in the said County of Surrey, gentleman, and of William Dovey of Shoe Lane aforesaid, founder, their executors and admons and assigns upon trust in the first place to pay thereout all my just debts funeral expenses and the charges of the probate of this my will and also the costs charges and expenses attending the execution of the trusts of this my will and also the legacies as following, that is to say 


To each of them the said William Hill and William Dovey the sum of £100 for his own use respectively 


To Elizabeth Penton of Denmark Hill in the said County of Surrey, widow of the late George Penton deceased £100 


To Susan Webber of Denmark Hill aforesaid, spinster, sister of the said Elizabeth Penton £50. 


To Mary Gardener of Denmark Hill aforesaid, spinster, niece of the said Elizabeth Penton £50 


To [ ] Hill wife of the said William Hill £50. 


To Charlotte Hill, of Brixton Hill aforesaid, spinster, £50. 


To [ ] Livermore of Chiswell Street Moorfields, London, founder, £50. 


To [ ] Livermore wife of the said [ ] Livermore £50. 


To William Fanthorpe late of Shoe Lane aforesaid but now of Poppins court Fleet Street aforesaid, engraver, £100. 


To John Williams of Walworth in the said County of Surrey, Gentleman, £100. 


To Thomas Walton of Walworth aforesaid, Gentleman, £50. 


To Grosvenor Banster ***** late of Vauxhall in the said County of Surrey, coal merchant, £50 


And to the said Thomas Haskins fifty pounds 


And I direct that each and every of the legacies given by this my will shall be paid free from any deduction for or on account of the duty on legacies and that the ****** of such duty on each and every of the said legacies shall be paid by my executors out of my trust estate 


And upon further trust that they the said William Hill and William Dovey and the survivor of them his executors and admons do and shall as soon as can conveniently may be after my decease appropriate and set apart such sum or sums of money as will on being laid out and invested in the 3% consolidated bank annuities produce one clear annuity or annual sum of £50 and so and shall lay out and invest such sum or sums of money as aforesaid in the purchase of **** the said 3% consolidated bank annuities and in their or his names or name and stand and be possessed of the sum or sums of money which is or are to produce the said annuity or annual sum of £50 and of the stock or fund in or upon which the said sum or sums of money shall be laid out and invested and of the dividends and interest or annual income to arise therefrom upon the several trust and for the ends intents and purposes hereinafter expressed, that is to say, Upon trust to pay the same dividends interest and annual income into the proper hands of Sarah Wood of No 104 Shoe Lane aforesaid, spinster, as and when the same shall become due and payable for and during the term of her natural life subject nevertheless to the trusts hereinafter declared for her separate use and I do expressly direct that the same dividends interest and annual income shall be paid to the said Sarah Wood for her own sole use separate and apart from and exclusive of her husband for the time being and so and in such manner that the same dividends interest and annual income may not be under his control nor subject or liable to his debts contracts forfeiture or engagements and in such manner that the receipts of the said Sarah Wood or of any person to whom she may appoint the same where or after the same shall be due may be sufficient discharges for the money which shall be thereby expressed to be received yet nevertheless so that the said Sarah Wood may not appropriate charge or assign all or any part of the same dividends interest and annual income before the same shall become due and payable and from and after the decease of the said Sarah Wood then upon trust to transfer assign pay apply and dispose of the trust moneys stocks funds and annuities hereinbefore given to or for the benefit of the said Sarah Wood **** left and the dividends interest and annual proceeds thereof, unto and amongst the child if only one or more the children if more than one of the said Sarah Wood equally to be divided between them share and share alike. And in case the said Sarah Wood should die without issue, then I direct that the said trust moneys stocks funds and securities and the dividends interest and annual proceeds thereof shall after the decease of the said Sarah Wood sink into and become part of the residue of my personal estate and belong to her executors or admons 


And as to all the rest, residue and remainder of my personal estate and effects of what nature or kind so ever and wheresoever upon trust to pay assign, transfer and deliver the same unto the said Sarah Wood to and for her own proper use and benefit, absolutely provided always and I hereby declare and direct that if the said William Hill and William Dovey or either of them or any trustee or trustees to be appointed under this present provision in their or other of their part shall die all refuse or decline to act in the trusts of this my will before the said trusts shall be fully executed and performed and now trustee or trustees for the time being last will be last surviving trustee his executors or admons and that the said trust moneys funds and promises shall in that case and as often as they shall occasion to be transferred and assigned to as to be vested in such new and such surviving or continuing trustee or trustees or on behalf such new trustee trustees only as the case may require upon the same trusts and for the same intents and purposes as are herein mentioned and declared of and in controlling the same or such of them as shall be then subsisting or capable of taking effect and that every such new trustee shall and may act in the execution of the said trusts as fully and effectually and to all intents and purposes whatsoever and with the same or the like purpose powers or authorities and considerations in all respects as if he had been originally appointed a trustee by this my will. 


Provided also and I hereby declare that no one or more of the executors of this my will or the trustees for the time being of this my will shall be answerable or accountable due for another and by **** for involuntary losses and that each and every of them respectively shall be allowed and shall pay retain and reimburse to and for himself and herself and their selves all his her and their costs **** and expenses to be occasioned by the due execution of the trusts hereby in him, her and them reposed 


And lastly I constitute and appoint the said Sarah Wood, William Hill and William Dovey to be executors in trust of this my will and hereby revoking every former Will by me at any time made declare this writing only to be my last Will and Testament 


In witness whereof I the said Francis Kinman the testator have to this my last Will and Testament contained in three sheets of paper written on one side only set my hand and seal to wit my hand and seal at the top of the first sheet where the several sheets are affixed together my hand to and at the bottom of the second sheet and my hand and seal to this the third and last sheet this fourth day of October in the year of our Lord 1823
