Will of John Benson of Sydney, NSW. 1872


This is the last Will and Testament of me John Benson of Sydney in the Colony of New South Vales, Landholder. 


I devise all my Real estates whatsoever and wheresoever in the world (except estates Wested in me as Mortgagee or Trustee) Unto my wife Mary Ann Benson for her own sole and separate use and benefit during her life, and after her decease: 


I devise all that piece or parcel of land situate in the Parish of Alexandria in the City of Sydney, County of Cumberland and Colony of New South Vales, being portion of Block number Fourteen of that part of the Riley Estate known as the Voolloomooloo Estate, bounded on the west by Yurong Street, commencing at a point on the East side thereof, distant seventeen feet northerly from a lane at the back of the allotments fronting Stanley Street, and bearing North one degree fourteen minutes, East One hundred and six feet; on the North by a line at right angles to Yurong Street bearing Easterly and measuring Seventy nine feet to a Creek parallel with and on the other side of which runs a line sixteen feet wide at the back of the allotments fronting Stanley Street and bearing North one degree fourteen minutes East one hundred and six feet; on the North by a line at right angles to Yurong Street bearing Easterly and measuring Seventy nine feet to a Creek parallel with and on the other side of which runs a lane sixteen feet wide at the back of the allotments fronting Riley Street and bearing Southerly to a line at right angles to Yurong Street; on the South by the said line Ninety eight feet to and bearing westerly to the point of commencement. 


Also all that piece or parcel of land situate in the Parish of Saint Lawrence in the City of Sydney, County of Cumberland, Colony of New South Vales, being part of Allotment number seven of Section six, granted to John Terry Hughes nineteenth October One Thousand eight hundred and thirty one. Bounded on the North commencing at a point on the East side of Castlereagh Street thirty four feet six inches Southerly from its intersection with Liverpool Street forty feet, on the East by other part of said allotment thirty four feet one inch, on the South by a private road thirty eight feet, on the West by Castlereagh Street thirty four feet three inches or thereabouts, be the said several dimensions a little more or less. 


Also all that parcel of land in Block Number 9 B of the Riley Estate Voolloomooloo containing Four and a half perches more or less. Bounded on the East by Crown Street, commencing at a point on the West side thereof distant Two hundred and forty two feet six inches Southerly from its intersection with the South side of Stanley Street and Bearing South one degree fourteen minutes West twelve feet six inches; on the South by a line bearing West one degree fourteen minutes North one hundred and two feet six inches to a back entrance sixteen feet wide; on the West by the East side of the said back entrance bearing North one degree fourteen minutes South one hundred and two feet six inches; on the North by a line bearing East one degree fourteen minutes South one hundred and two feet six inches, dividing it from a parcel of land sold by one Edward Rawlings to Michael Harmon, to the point of commencement. 


And also all that piece or parcel of land in the Colony of New South Vales, in the City of Sydney, in- Parramatta Street. Commencing at a point on the South side of Parramatta Street distant twenty eight feet six inches Easterly from the North East corner of Dalton's Lane, and bounded on the North by Parramatta Street, bearing Easterly thirty five feet three inches; on the East by a line Southerly dividing it from Linden's property ninety six feet to a lane ten feet wide; on the South by the North side of said lane thirty five feet three Inches; and on the West by a line Fartherly ninety six feet to the point of commencement, be the said several dimensions respectively a little more or less, being Lot one and part of Lot two of the subdivision of one acre and thirty perches of land formerly sold for the benefit of the School of Industry. 


Together with all Buildings on the said several parcels of land, and all ways, rights, members privileges and appurtenances thereto belonging, Unto and to the use of my son John Benson the younger, his heirs and assigns for ever. 


I devise all that parcel of land containing by admeasurement twelve perches more or less, situate in the Parish of Saint James in the City of Sydney in the said Colony, being part of Allotment three of Section Thirty nine comprised in a Grant from the Crown to Thomas Boss, of two roods and twenty six perches, dated the ninth day of March one thousand eight hundred and thirty seven. Which said land and premises are bounded on the West by Castlereagh Street bearing Southerly forty one feet, on the South by other part of the said Grant bearing Easterly seventy nine feet; on the East by other part of the Said Grant bearing Northerly thirty nine feet, and on the North by other part of the said Grant bearing Westerly to Castlereagh Street seventy nine feet, be the said several dimensions respectively a little more or less. 


And also all that parcel of land containing by admeasurement twenty perches and situate in the Town of Sydney, Parish of Saint Lawrence, County of Cumberland, bounded on the West by Pitt Street bearing South five degrees East sixty nine links, on the South by number nineteen Allotment bearing East Three degrees thirty minutes North one hundred and eighty six links, on the East by number eleven Allotment bearing North five degrees West sixty seven links, and on the North by number seventeen Allotment bearing West two degrees thirty minutes South one hundred and eighty eight links, being Allotment Number Eighteen of Section fourteen described in the Government Notice of Twenty sixth' September one thousand eight hundred and thirty one. Together with the Dwelling Houses and Buildings erected on the said parcels of land, And all the ways, rights, members privileges and appurtances thereto belonging, Unto and to the use of my son Henry George Benson, his heirs and assigns for ever. 


I devise all that piece or parcel of land lying and being situate on the West side of Elizabeth Street in the City of Sydney in the Colony aforesaid, containing by admeasurement twenty and a half perches a little more or less, commencing at the Northern boundary line of Josephson's property at a point ninety five feat distant bearing Easterly from the North West corner thereof, and bounded an the West by a line bearing Northerly fifty three feet, thence on the South by a line bearing Westerly sixteen feet, then again on the West by a line bearing Northerly thirty nine feet, on the North by a line bearing Easterly seventy two feet to Elizabeth Street, on the East by Elizabeth Street bearing Southerly eighty eight feet six inches to the North East corner of the said Josephson's property, and thence again on the South by part of the Northern boundary line of the said property bearing Westerly fifty eight feet to the point of commencement, be the said several dimensions a little more or less, with the ways, rights members privileges and appurtances thereto belonging. 


Also all that piece or parcel of land situate lying and being in the Parish of Alexandria in the City of Sydney in the County of Cumberland in the Colony of New South Vales, commencing at the North East corner of James Giffins purchase in Crown Street distant one hundred and nineteen feet seven inches northerly from the intersection of that Street with William Street and bounded on the East by Crown Street bearing North one degree fourteen minutes East sixteen feet, on the North by a line bearing West one degree fourteen minutes North dividing it from other part of Allotment Number twelve seventy five feet six inches, on the West by a Southerly line parallel to Crown Street sixteen feet to James Giffins Allotment, and on the South by that Allotment bearing East one degree fourteen minutes South seventy five feet six inches to the commencing corner in Crown Street aforesaid, which said piece or parcel of land comprises parts of Allotments numbers Eleven and Twelve of Block Twenty Two E of that part of the Riley Estate known as the Voolloomooloo Estate. 


Also all that piece or parcel of land situate in the City of Sydney in the said Colony, bounded on the North by the parcel of land lastly herinbefore described four feet, on the West by land now or late belonging to John Hill Junior sixteen feet, on the East by land lately belonging to James Lumsden sixteen feet, and on the South by a lane (sixteen feet wide) four feet. 


And also all the residue of my real estate whatsoever and wheresoever (except Estates Wested in me as Mortgagee or Trustee) Unto my Daughter Mary Ann Crompton and her heirs, To such uses upon such trusts and for such ends intents and purposes as she shall notwithstanding her present or any future coverture by any Deed or Deeds or by her last Will and Testament or any Codicil thereto appoint and in default of and until such appointment To and for the sole and separate use of the said Mary Ann Crompton her heirs and assigns for ever.


I bequeath all that leasehold property situate in Derwent Street Glebe purchased by me from Sarah O'Connor unto my said wife for and during her life, and after her decease, Unto my said son John Benson the younger absolutely. 


I devise and bequeath all estates Vested in me as Trustee or Mortgagee (subject to the equities affecting the same) and bequeath all the residue of my personal estate (subject to the payment thereout of my Just debts and funeral and Testamentary Expenses) unto my said wife absolutely. 


I appoint my said wife Executrix of this my Will. In witness whereof I have hereunto set my hand this tenth day of January one thousand eight hundred and seventy one.

This day upon Petition Probate of the last Will and Testament of John Benson deceased was granted to Mary Ann Benson the widow of Testator and the sole Executrix in the said Will named. 


Testator died on the 7th day of December 1872. 


Goods sworn at £5,500. Probate dated the same day as granted.
