Will of Thomas Kinsman, farmer of Fayette, Wisconsin. 1864

I Thomas Kinsman of the town of Fayette in the county of La Fayette in the State of Wisconsin being of sound mind and memory but considering the uncertainty of this frail life do make publish and declare the following as and for my last will and testament, viz: 

I give and bequeath to my beloved wife Mary Kinsman all my household furniture of every nature and description whatever, also all my cattle, horses, wagons, sleds, hogs in fact all my personal property of every nature kind and description of which I am now the owner or which I may die seized except the span of colts and also any other exception herein contained. 

I give and devise to my said wife my homestead on which I now reside consisting of the north east quarter of the north west quarter of section thirty in town four north of range 4 east in the said count of La Fayette except ten acres on the north end of the said tract deeded to John Reynolds, also ten acres lumber tract on the north end of the north east quarter of the south east quarter of section eighteen in town four range four east, being the same as described in a deed from Martin V Burns and wife dated January 23rd 1864 and recorded in Iowa County in volume 9 of deeds on page 429 to have and to hold the same during the term of her natural life together with all the rents issues and profits thereof. 

I give and devise unto my son Thomas Kinsman junior the north west quarter of section number nineteen in Township number four north of range four east in La Fayette county aforesaid subject to the condition that he shall pay or cause to be paid to my said wife Mary Kinsman the sum of fifty dollars per year to commence immediately after my decease to be paid year by year and yearly. 

I also give to my said son Thomas my span of colts now rising three years old and he shall be at liberty to take possession of them at any time after his return from the army. 

I also give and devise to my said son Thomas the five acre timber lot in the north east quarter of section nineteen in town four north of range four east in La Fayette county aforesaid. 

I give and devise to my three children Joanna, Nicholas and Thomas the south west quarter of the north west quarter of section twenty-one in township number four north of range four east to be equally divided among them share and share alike. 

I give and bequeath to my grand daughter Sarah A May a cow and fifty dollars in cash to be paid to her out of my personal property at any time after my decease. 

And it is my will that after my wife's decease that all the property bequeathed to her both real and personal over and above what shall have been necessary for her support and comfort and which shall remain undisposed shall be equally divided between all my children share and share alike. 

And finally it is my will that all my just debts and funeral expenses shall be paid. 

And I hereby appoint and constitute my wife Mary and Joseph May my son in law executors of this my last will and testament and I hereby revoke all former wills by me made 

In witness whereof I have hereunto set my hand and seal this 6th day of October AD 1864
