Will of Andrew Kinsman, Gentleman of Devonport. 1832

In the name of God Amen

I, Andrew Kinsman of Devonport in the County of Devon, Esquire, do make and publish this, my last Will and Testament in manner following, that is to say;

as to for and considering all that my freehold heredit and premises called or commonly known by the name of the Old Tabernacle situate in Briton side in the Borough of Plymouth in the said County of Devon and which was **** *** for many years last past employed or made use of as a place of religious Worship by Protestant Dissenters professing and believing the Articles of the Church of England,

I give and devise the same with the rights, ******** and appurts thereto belonging unto and to the use of Andrew Kinsman of East Stonehouse in the said County of Devon, a Major in the Royal Marines, John Guyse Sparke of Devonport aforesaid, Surgeon, Samuel Paramour of the same place, clerk in His Majesty’s dockyard, these and Robert Knish of Devonport aforesaid, merchant, and their heirs, upon trust that they my said trustees, and the survivor of them and the heirs, executors, advisors and assigns of such survivors, be and shall permit and suffer the same hereditaments and premises to be used and appropriated for the purpose aforesaid only by such Protestant Dissenters, with the usual and accustomed free liberty of ingress and egress for them through the day by a passage leading from my dwelling house and premises at all reasonable hours, for the Worship of Almighty God without any let or hindrance or denial whatsoever, they the said Protestant Dissenters keeping the same and every part thereof at all times in good and substantial repair and condition, and so as that the same be not used and appropriated or converted to any other purpose as a place of Worship by those only who profess and believe in the Divinity and Godhead of our Lord and Saviour Jesus Christ as God over all classes for ever Co-equal and Co-eternal with the Father and Holy Ghost, one God in three persons

provided always and it is my Will and the before mentioned devise is by me made upon this Express condition that if: the said heredits and premises should be used or appropriated for any other purpose than as aforesaid; or any other doctrine preached or taught therein as aforesaid; or the said premises should not be kept in good and substantial repair and condition, then and in either of such cases I revoke and make void the before mentioned devise and I will and devise that my said Trustees, and the survivor of them and the heirs executors advisors and assigns of such survivor, shall stand seized and possessed thereof and of every part thereof upon Trust to convey and assure the same hereditaments and premises unto and to the use of my children Catherine Rimer Kinsman, Andrew Guyse Kinsman, William Poole Kinsman, Elizabeth Poole Chaff , Johanna Guyse Kinsman and John Guyse Kinsman in equal shares and proportions as tenants in common, and of the several and respective heirs and assigns of my said children for ever.

All the rest, residue and remainder of my lands and tenements, goods and chattels, personal and testamentary estate and effects of what nature or kind so ever or wheresoever, subject to the payment of my just debts, funeral expenses and the charges of proving this my Will, I devise and bequeath the same and every part or parcel thereof according to the different natures and qualities thereof respectively unto and to the use of my said six children in equal share and proportions as tenants in common, and their several and respective heirs, executors, advisors and assigns.

And I do hereby nominate and appoint the said Andrew Guyse Kinsman, Johanna Guyse Kinsman and John Guyse Kinsman Executors and Executrix of this my Will, hereby revoking all former and other Wills by me at any time heretofore made and declaring this to be my last Will and Testament

In witness whereof I have hereunto set my hand and seal this tenth day of November in the year of our Lord one thousand eight hundred and thirty-two.

This is a Codicil to the last Will and Testament of me Andrew Kinsman of Devonport in the County of Devon, Gentleman, bearing date the tenth day of November 1832.

Whereas I have since the date and execution of my said Will considered that there is no necessity for putting the Old Tabernacle into the hands of Trustees one of those herebefore mentioned being since dead, viz: Robert Knish, I do hereby take the same out of the hands of the Trustees therein mentioned, viz: Andrew Kinsman, Major of the Royal Marines, John Guyse Sparkes, Surgeon, and Samuel Paramour, Clerk in his Majesty’s dockyards, and do hereby give and devise all that my freehold, heredits and premises called or occasionally known by the name of the Old Tabernacle, situate in Briton side in the Borough of Plymouth in the County of Devon, to my youngest son John Guyse Kinsman enjoining on him not to let the aforesaid Tabernacle be used appropriated or converted to any other purpose than as a place of worship and those who profess and believe in the Divinity and Godhead of our Lord and Saviour Jesus Christ as God over all classes for ever co-equal and co-eternal with the Father and Holy Ghost, one God in three persons, on these conditions I do give and devise the said Tabernacle to my youngest son John Guyse Kinsman.

In witness whereof I have hereunto set my hand and seal this nineteenth day of March in the year of our Lord one thousand eight hundred and thirty-five.

Proved at London with a codicil 21st January 1836 before the judge by the oaths of Andrew Guyse Kinsman the son, Johanna Guyse Kinsman, spinster, the daughter and John Guyse Kinsman, the son, also the executors to whom admon was granted having been first sworn by Counsel only to administer.
