Will of Robert Jope, Gentleman of Callington. 1761

This is the last will and testament of me Robert Jope of the Borough of Callington in the County of Cornwall, Gentleman, made, published and declared this second Day of October in the year of our Lord one thousand seven hundred and sixty one when of sound perfect and disposing mind and memory.

First I bequeath my soul unto Almighty God, who gave it me and my body I commit to the earth to be decently interred at the direction of my Executors in trust hereinafter named.

I give and bequeath unto each of my two daughters Elizabeth and Margaret the sum of one hundred pounds and unto my daughter Ursula the sum of one pound and one shilling and unto my daughter Ann the sum of thirty pounds to be respectively paid unto them when and as they shall attain their respective ages of one and twenty years.

And my will is and I hereby direct that all and every my said daughters shall be educated and maintained by my said [Executors] in trust by and out of the trust estate hereby given and devised unto them as well meat, drink, washing, lodging, physick, and apparrell of all sorts as in all other necessarys whatsoever at the discretion of my said Executors in trust until they shall attain their said respective ages of one and twenty years.

Also I give devise and bequeath unto Mary my wife, Richard Turner of Tavistock in the County of Devon, Gentleman, and David Horndon Gent. of the Borough of Callington, all my messuages, lands, tenements, hereditaments as well leasehold as freehold situate lying and being in the Borough and Parish of Callington aforesaid or elsewhere in the County of Cornwall. To have and to hold the said freehold messuages lands tenements and hereditaments with their and every of the appurtenances unto my said wife, the said Richard Turner and David Horndon their heirs and assigns forever to have and to hold the said leasehold messuages and tenements with the appurtenances unto my said wife, the said Richard Turner and David Horndon their executors administrators and assigns for and during the several and respective estates terms and interests which I shall have therein at the time of my death.

In trust nevertheless and to and for the several uses ends interests and purposes herein after mentioned limited expressed and declared of and remaining the same (that is to say) upon trust that they my said wife, Richard Turner and David Horndon and their survivors, survivor of them, his and her heirs executors and administrators do and shall by and out of the rents, fines and profits of all and singular the said premises as well leasehold as freehold, or by demism, leasing, mortgaging or selling all or any part of my freehold lands within the said Borough of Callington. In the first place raise levy and pay all such debts sum and sums of money as I shall owe or be any wise indebted at the time of my death and in the next place the said legacies and maintenances herein before given bequeathed unto my said daughters as aforesaid. And also such sum or sums of money as they or either of them in his her or their discretion shall think necessary for the maintenance and education of my son John Jope until he shall attain his age of one and twenty years and for the binding him an apprentice to some trade or profession and from and after the payment and discharge of my said debts legacies and maintenances aforesaid. Then in trust and to and for the only use benefit and behalf of my said son John Jope and his heirs executors and administrators and to or for no other use intent or purpose whatsoever.

And I hereby make constitute and appoint my said wife, the said Richard Turner and [David Horndon] joint executors and executrix of this my said last will and testament in trust nevertheless to and for my said son until he shall attain his age of one and twenty years and from and after his attaining that age I make constitute and appoint him whole and sole executor of this my said last will and testament and I do hereby commit unto my said executors in trust the guardianship and tuition of my said son and daughters until they shall attain their respective ages of one and twenty years provided always and my will is and I hereby order and direct that the purchasor or purchasors of all or any part of my said messuages lands tenements or hereditaments shall not be obliged to see the application of his her or their purchase money but that the receipt and receipts of my said wife, the said Richard Turner and David Hordon or the survivors, survivor of them, his or her heirs executors and administrators, shall be good and sufficient discharges for the same to all intents and purposes whatsoever.

Provided also and my will further is that in case any loss or losses shall happen in the execution of the trusts aforesaid the same shall not be born or sustained by my said executors in trust or the survivors or survivor of them or by the heirs executors or administrators of such Survivor but by the person or persons who would have been intituled thereto if no such loss or losses had happened.

And I do hereby further direct that neither of my said trustees shall be responsible for any more of my trusted estate than shall actually come to his or her hands or be answerable for the act or acts of the other but each of them for his or her own acts and receipts only.

Also my will ****** is and I hereby direct that my said executors in trust and the survivors and survivor of them and the heirs executors and administrators to such survivor shall reimburse him her or themselves out of my said estate all such cash charges and expenses as he she or they shall lay out expend or be putt unto in about or any wise concerning the said trusts hereby reposed in them.

In Witness whereof I the said Robt Jope the Testator have hereunto sett my hand and seal the day and year first within written

Signed sealed published and declared by the above named Testator Robt Jope to be his last Will and Testament in presence of us who at his request and in his presence have subscribed our names as witnesses hereunto, the interlineation of the words [of my freehold lands within the said Borough of Callington] being first made
